- MiWay Insurance Limited is a company registered in terms of the laws of the republic of South Africa, with registration number 2007/026289/06, a licensed non-life insurer and financial services provider (FSP No. 33970) hereinafter referred to as (“MiWay”).
- Please read these Terms and Conditions carefully as they apply to your use of this website. If you do not accept the terms and conditions outlined, please do not continue to use this website.
- MiWay may revise these Terms and Conditions at any time by updating this page without any prior notice. You are advised to review this page periodically, as these terms and conditions are binding upon you.
- All the information on our website is intended as general information about MiWay, our products and services. The information provided on this website should not be treated as professional advice in any way and was correct at the date it was published.
- Please note, we take the law seriously and ascribe to the Electronic Communications and Transactions Act.
3-month online offer
- The 3-month online offer is only open to a personal lines policyholder who initiates and completes a quote for a policy online. (No call centre agent interaction in terms of capturing any information).
- The non-life insurance policy with MiWay is taken up online.
- The first three consecutive months’ full premium must be successful. This excludes pro-rata premiums. If any one of the first 3 months’ premium is reversed, the policyholder will not qualify for the reward.
- The policyholder will be paid the average of the first three months’ consecutive premiums, into the bank account as on the client’s policy and on the same date that the 4th premium is scheduled to be collected.
- MiWay reserves the right to cancel the 3-month online offer or to change the Ts and Cs at any time at its discretion without prior notice.
General terms of use:
- In order to access your profile on the website, you must register a profile. Use of the website includes, but is not limited to, requesting and completing a quotation and accepting a quotation and therefore entering into an Insurance Policy with MiWay.
- You acknowledge and accept that you must provide true and complete information on the website at all times. Should any information change, you will update your profile on this website.
- In the event that you have a Policy with MiWay, the current status of your cover is reflected in your profile on the website and on your Coversheet (policy schedule), a copy of which is also stored in your profile on the website. By using this website, you consent to receiving important information, documentation and correspondence electronically.
- If there is any conflict between the Coversheet, FAIS Disclosure Notice or Policy Wording (“policy documents”) and these Terms of Use, the policy documents will prevail.
- When accessing your profile on MiWay’s website, always keep your login details safe and confidential. This will ensure that nobody can access your information without the necessary authorisation to do so.
- All information is viewed, downloaded or printed for personal use only.
- All copyright and intellectual property rights to all content on this website is owned by and vests in MiWay – including logos, other graphics and multimedia elements. If you would like to use any information from this website, you must credit MiWay clearly.
- Never use any of MiWay’s trademarks without MiWay’s prior written consent. This includes linking to this website in any way, if you believe you have a valid case, send us an email to marketing@miway.co.za and depending on our relationship and business strategy, we may agree or not. If you use MiWay’s trademarks without MiWay’s prior written consent, MiWay is entitled to take legal action and any legal and/or associated costs will be for your account.
- Any email address, name, telephone number, WhatsApp number or fax number on this website IS NOT to be used for electronic marketing or database building purposes. The fact that we display this information does not imply that we consent to the use of this information for database building purposes.

- Should it, in MiWay’s sole discretion, be found that you have used the website for any unauthorised and/or illegal purposes, your profile on the website will be terminated immediately and MiWay may exhaust all legal remedies available to it and you will be held liable for all costs incurred by MiWay.
MiWay cannot promise or guarantee:
- That this website will be available and functional 100% of the time.
- That all downloads from this website will always be free of viruses and will not damage your phone and/or computer or the data on it.
- The nature, content and availability of the third-party website links. MiWay also cannot control or guarantee the accuracy or quality of the information, material and graphics from these links. - The security of any data you supply MiWay with on this website is subject to minimum security levels as may be prescribed by applicable laws. Although we have built-in safeguards to ensure security, privacy and confidentiality of that information, this is entirely at your own risk.
Availability and Termination:
- MiWay may in its sole discretion and at any time, for any reason and without prior notice, suspend or terminate the operation of this website (in whole or in part) or your right to access your profile on the website, including, but not limited to, for scheduled and unscheduled maintenance of the website; which may impact the availability and functionality of the website, but not the validity of a Policy purchased prior to such suspension or termination. If you breach any of these Terms of Use or other policies to which you agree, we may terminate your access to your profile on the website with immediate effect.

We obtain and maintain information about you in various ways.
- What information do we collect?
- Information you provide directly:
- Personal information submitted by you on the website and/or the MiWay App, such as name, surname, identity number, cell-phone number, email address, registration number and/or VIN number. MiWay values your personal information (as defined by the Protection of Personal Information Act) and promises to comply with the Protection of Personal Information Act.
- In the event that you download and register a profile on the MiWay App, we will also collect information about your use of the App:
- In the event that you have opted into the telematics features on the App, which includes crash detection, you will be required to allow permissions on the App for us to track driving information which includes location services, activity recognition on Android or Motion and Fitness on iOS, and Bluetooth (whenever applicable), in order for you to receive or use the services on the App. We will be able to track your exact geolocation once you have allowed permissions on the App. If you decline permissions on the App, you will not be able to benefit from the MiWay product features which rely on telematics data and MiWay would not be able to detect when you were in a car accident.
- In-App usage information, including, chats, menus and settings clicked, features used, frequency and duration of use of the App, and severe impact report data. We use features such as Google Analytics to track this.
- Device information, such as firmware version, operating system and device identifiers.
- MiWay makes use of cookies in order to evaluate and enhance the product and services offered on the App. Cookies are text files containing small amounts of information, which your computer or mobile device downloads when you visit the App. Cookies help us to understand how the App is used, let you navigate between pages and generally improve your browsing experience. By continuing your visit to our App, you consent to the use of cookies. There are various ways to block cookies or to opt out by using the Google Analytics opt-out browser add-on.
- How do we use your information?
- To provide insurance quotations and policies.
- To mobilise emergency assistance services.
- To monitor trips to provide the crash detection services (Emergency Alert), if you have opted-into this feature on the App.
- For claim information, claims submissions and to validate claims.
- To send you important policy information and documentation.
- To respond to your requests, inquiries and instructions made through this website, the MiWay App or any other communication channels.
- To provide promotions and offers by way of direct marketing communications, only where you have given us your consent.
- To operate, evaluate and improve our business (including developing new products; analysing, enhancing and improving our products; managing our communications; performing data analytics; and performing accounting, auditing and other internal functions).
- To comply with and enforce applicable legal requirements, relevant industry standards and our policies.
- Who do we share your information with?
We will disclose your information internally within our business and to the following entities:
- Business Partners that we work with in order to provide you with the services noted on the website, in the MiWay App and other policy documentation but these partners may never sell your information or re-use them.
- Service Providers that we have selected to provide services for or on behalf of us in order for us to ensure we deliver on our obligations to you.

All comments on MiWay’s website appear as they are loaded by you, the public. It is our policy to post ALL comments unless they do not comply with our guidelines below:
- MiWay welcomes all comments – both negative and positive – from anyone, regardless of whether you are a client or not.
- The MiWay comments page is intended for open, transparent conversations in which people discuss and share ideas, notify MiWay of any issues, compliment us and of course ask questions.
- We are committed to maintaining a non-toxic atmosphere. Therefore, we do not allow profanity, hate speech, nor do we allow speech that advocates or supports hatred, unlawful activities or violence. Likewise, threats of violence or threats to anyone or any group’s personal safety are not acceptable. We also do not allow false claims or misleading implications that any individual or group perpetuates hate or violence.
- In order to preserve a functional and civil conversation, we do not allow trolls, trollish behaviour - in other words, speech that is solely intended to provoke other users, to cause disorder or confusion, or to inhibit regular, on-topic conversation, or stalking.
- We do not allow and will delete all comments containing business solicitations or other advertising of personal interests, blogs, or websites.
