  • MiWay Insurance Limited is a company registered in terms of the laws of the Republic of South Africa, with registration number 2007/026289/06, a licensed non-life insurer and financial services provider (FSP No. 33970) hereinafter referred to as ("MiWay ", "we", "us", "our"”).
  • MiWay may revise these Terms and Conditions at any time by updating this page without any prior notice. You are advised to review this page periodically, as these terms and conditions are binding upon you.
  • All the information on our website is intended as general information about MiWay, our products and services. The information provided on this website should not be treated as professional advice in any way and was correct at the date it was published. Please note, we take the law seriously and ascribe to the Electronic Communications and Transactions Act.
  • If there is any conflict between the Coversheet, FAIS Disclosure Notice or Policy Wording (“policy documents”) and these Terms of Use, the policy documents will prevail.
  • When accessing your profile on MiWay’s website, always keep your login details safe and confidential. This will ensure that nobody can access your information without the necessary authorisation to do so.
  • All information is viewed, downloaded or printed for personal use only.
  • All copyright and intellectual property rights to all content on this website is owned by and vests in MiWay – including logos, other graphics and multimedia elements. If you would like to use any information from this website, you must credit MiWay clearly.
  • Never use any of MiWay’s trademarks without MiWay’s prior written consent. This includes linking to this website in any way, if you believe you have a valid case, send us an email to marketing@miway.co.za and depending on our relationship and business strategy, we may agree or not. If you use MiWay’s trademarks without MiWay’s prior written consent, MiWay is entitled to take legal action and any legal and/or associated costs will be for your account.
  • Any email address, name, telephone number, WhatsApp number or fax number on this website IS NOT to be used for electronic marketing or database building purposes. The fact that we display this information does not imply that we consent to the use of this information for database building purposes.
  • Any information, document or other material made available by this website is without any warranty of any kind, either express or implied, including, but not limited to the warranties of completeness, accuracy, fitness or non-infringement.
  • MiWay disclaims any liability and is not liable to any user for any direct, indirect or consequential damages caused by the errors or omissions, whether negligent or otherwise, in any information, document or other material provided or available within this website.
  • This website, its content, these terms of use and MiWay’s business shall be governed and interpreted in accordance with the laws of the Republic of South Africa.
  • Should it, in MiWay’s sole discretion, be found that you have used the website for any unauthorised and/or illegal purposes, your profile on the website will be terminated immediately and MiWay may exhaust all legal remedies available to it and you will be held liable for all costs incurred by MiWay.

3-month online offer

  • The 3-month online offer is only open to a personal lines policyholder who initiates and completes a quote for a policy online. (No call centre agent interaction in terms of capturing any information).
  • The non-life insurance policy with MiWay is taken up online.
  • The first three consecutive months’ full premium must be successful. This excludes pro-rata premiums. If any one of the first 3 months’ premium is reversed, the policyholder will not qualify for the reward.
  • The policyholder will be paid the average of the first three months’ consecutive premiums, into the bank account as on the client’s policy and on the same date that the 4th premium is scheduled to be collected.
  • MiWay reserves the right to cancel the 3-month online offer or to change the Ts and Cs at any time at its discretion without prior notice.

MiWay cannot promise or guarantee:

  • That this website will be available and functional 100% of the time.
  • That all downloads from this website will always be free of viruses and will not damage your phone and/or computer or the data on it.
  • The nature, content and availability of the third-party website links. MiWay also cannot control or guarantee the accuracy or quality of the information, material and graphics from these links. The inclusion of any such links does not necessarily imply a recommendation or endorsement of the views expressed within them. If you come across any external links that do not work, please report them to marketing@miway.co.za.
  • The security of any data you supply MiWay with on this website is subject to minimum security levels as may be prescribed by applicable laws. For practical business reasons and because the law might require it, we need to store some of your information in our databases. Although we have built-in safeguards to ensure security, privacy and confidentiality of that information, this is entirely at your own risk.

E-mail disclaimer:

  • E-mails sent by MiWay contain privileged or confidential information and may be subject to legal privilege. E-mails and any files transmitted with it are intended solely for the use of the individual or entity to whom they are addressed. Access to e-mails by anyone other than the intended individual or entity is therefore strictly prohibited. If an e-mail is received in error, please notify MiWay immediately. If you are not the intended recipient you are notified that disclosing, copying, distributing or taking any action in reliance on the contents of this information is strictly prohibited.

SMS disclaimer:

  • Please note that the terms of use set out below include but is not limited to messages sent via the internet on platforms such as WhatsApp or similar.
  • MiWay will in no event be responsible for any direct, indirect, special or consequential loss or expense that may be attributable, directly or indirectly, to the use of SMS’s.
  • MiWay will not be responsible for any interruption, delayed or failed transmission, loss of data, storage or delivery of information resulting from any cause.
  • All information sent by us via SMS is provided without any representation or warranty whatsoever, whether expressed or implied. In particular, MiWay makes no representation or warranties about the correctness of any information contained, the sustainability of any products or services mentioned or the soundness of ay general advice offered in an SMS.
  • The use of, and information appearing in SMS’s is governed and interpreted in accordance with the laws of the Republic of South Africa.
  • Nothing on any SMS should be construed as granting (by implication, estoppel, or otherwise) any license or right to use any intellectual property rights envisaged in the previous point without our written permission. You may not use the name of MiWay or logo in any way without our prior written permission.
  • MiWay reserves the right to refuse to provide any SMS service if: (a) you breach these Terms of Use; (b) we’re unable to verify or authenticate any information that you provide to us; (c) we believe that you are conducting activities that are illegal or abusive, or put MiWay in disrepute.
  • You agree to indemnify and hold harmless any member of MiWay – and including our respective directors, officers, employees, agents, licensors, suppliers, and any third-party information providers – from and against all losses and expenses (including attorney and own client costs resulting from you violating these Terms of Use.
  • The user for this site hereby indemnifies and holds MiWay harmless against all and any loss, liability, action, law suites, proceedings, costs, demands, and any damages of all and every kind, (including but not limited to, direct, indirect, special, or consequential damages), and whether in an action based on contract, negligence or any other action, arising out of or in connection with the failure delay in the performance of the services offered on this website, whether due to MiWay’s negligence or not.
  • Due to the lack of personal contact in online communication and transactions, MiWay relies exclusively on the correctness and accuracy of information submitted and the good faith of its online customers. Failure to provide honest, accurate and complete disclosure may lead to the annulment of policies.
  • Online customers must keep confidential their personal usernames and passwords, at all times. MiWay shall be entitled to presume the authenticity and validity of any online communication or transaction and that the online customer is the originator of such online communication or transaction where the username or password of that online customer is used to gain access to, view and/or engage in any activity or transaction or service offered on this website.
  • The online customer hereby indemnifies MiWay, its employees, representatives service providers and holds them harmless against any and all claims, losses and damages which MiWay or any third-party may incur as a result of reliance placed on any information, data and material furnished by a prospective policyholder or policyholder to MiWay.

Availability and Termination:

  • MiWay may in its sole discretion and at any time, for any reason and without prior notice, suspend or terminate the operation of this website (in whole or in part) or your right to access your profile on the website, including, but not limited to, for scheduled and unscheduled maintenance of the website; which may impact the availability and functionality of the website, but not the validity of a Policy purchased prior to such suspension or termination. If you breach any of these Terms of Use or other policies to which you agree, we may terminate your access to your profile on the website with immediate effect.

Restricted Use:

Unless otherwise indicted in writing, all information, products, and services displayed on or accessed through the MiWay website are for your personal and non-commercial use only. You may not:

  • Reproduce, modify, or create derivative works from; publish, distribute, transmit, or display; or license or transfer any of the content displayed on the website - unless you have MiWay’s prior written authorisation.
  • Decompile, reverse engineer, or disassemble the website, a linked website, or any software employed in the display or operation of the website.
  • Post on or transmit to the website content of an unlawful nature, for example: (a) content that is threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane; or (b) content that could damage MiWay’s image or impair its ability to do business.
  • Use the website in a manner that could damage, disable, overburden, or impair any MiWay’s server (computer), or network connected to any MiWay server, or interfere with any other party's use of the MiWay website.
  • Interfere with any content displayed on the MiWay website or attempt or gain unauthorised access (without MiWay’s written consent) to the information displayed on the website to which you may not be authorised, or to any secure area on the website, a MiWay server or any other part of the MiWay information system. Any attempt, whether successful or unsuccessful, to interfere with the information displayed on the MiWay’s website or to gain access to information or any part of the MiWay information system to which you are not authorised, is unlawful and is an offence in terms of the provisions of Section 86 of the Electronic Communications and Transactions Act No. 25 of 2002, for which you may be prosecuted and, if found guilty, punished.
  • Create a link from another website to the MiWay website, or any of the web pages which constitute the MiWay website, without MiWay’s prior written consent.
  • Frame the website or any of its pages without MiWay’s prior written consent.

User ID and Password:

If you subscribe to a service or product provided on the MiWay website, you may be required to choose a user id (an identifying name) and a password. You are entirely responsible for –

  • Maintaining the confidentiality of your password (you must not give the password to anyone else).
  • All activities that occur in your account (using your user id and, if required, your password), either with or without your knowledge.
  • Notifying MiWay immediately of any unauthorised use (use that you did not consent to) of your user id and/or password or any other breach of security that you know of.
  • For loss suffered by MiWay or a third-party due to someone other than you using your user id and/or password.

    • All promotions by MiWay Blink (a division of MiWay Insurance Limited) will not be applicable to policies underwritten through the MiWay App, website or any other medium, unless it is specifically specified in the promotion that it is applicable to policies underwritten through the MiWay App, website or any other medium.

Some notes on what we allow on our comment forums...

All comments on MiWay’s website appear as they are loaded by you, the public. It is our policy to post ALL comments unless they do not comply with our guidelines below:

  • MiWay welcomes all comments – both negative and positive – from anyone, regardless of whether you are a client or not.
  • The MiWay comments page is intended for open, transparent conversations in which people discuss and share ideas, notify MiWay of any issues, compliment us and of course ask questions.
  • We are committed to maintaining a non-toxic atmosphere. Therefore, we do not allow profanity, hate speech, nor do we allow speech that advocates or supports hatred, unlawful activities or violence. Likewise, threats of violence or threats to anyone or any group’s personal safety are not acceptable. We also do not allow false claims or misleading implications that any individual or group perpetuates hate or violence.
  • In order to preserve a functional and civil conversation, we do not allow trolls, trollish behaviour - in other words, speech that is solely intended to provoke other users, to cause disorder or confusion, or to inhibit regular, on-topic conversation, or stalking.
  • We do not allow and will delete all comments containing business solicitations or other advertising of personal interests, blogs, or websites.
